Terms of Service (TOS)

By ordering ANY of our services you have agreed to the following terms.

Customers generally have unrestricted control of their servers and webspace, but there are limits to what we can allow on our end to maintain fairness to all and keep prices low.

Terms of Service are listed below. This list is subject to change, so customers should check it frequently. If a customer violates the Terms of Service he or she will receive a warning and will be required to remove the offending material (by either Gizzmos Networks employees or voluntarily by the customer) on the first offense, a temporary disabling of the server on the second offense, and a cancellation of service on the third offense. For violations that cause significant monetary damage to Gizzmos Networks, the customer may have his or her server disabled on the first offense.

Payments: The subscriber agrees to pay the bill on time and without delay. Any bills that are more than 3 days late may be charged a 15% late fee. Failure to pay the bill on time may result in suspension or termination in service.

Space and Bandwidth: The subscriber agrees to only use the amount of space and the amount of bandwidth that is within the limits of his/her hosting plan. If the subscriber uses over the amount of space or bandwidth, he/she will be notified and will be forced to pay the extra amount that he/she is using. If notified he/she will have the option of stopping the account until the next month.

Refunds: ALL payments to Gizzmos Networks will be nonrefundable. We reserve the right to ONLY issue refunds based on downtime. In the case where Gizzmos Networks decides to issue a refund, the setup fee will not be refunded.

Account Cancellations: All request for account cancellations must be made 7 days prior the the bill due date. If you fail to inform us that you will be canceling, you will still be billed.

Tech Support: We are not responsible if we can not resolve your issue on time due to downed phone lines or downed internet.

Customer Responsability: As a customer it is your responsabilty to run your own gameserver. We are not responsible for creating admin accounts, we will not add custom maps or sounds, and we will not config your gameserver for you.

Gameserver/Web Hosting: You are not allowed to host any illegal files on your FTP. If you are found with illegal files we will permanently terminate your account without any notice. You are also not allowed to host any files on your game server FTP that is not related to the game itself. This means only server config files, mods, maps, ect.

CPU Usage: We reserve the right to disable any plugin that is using more than their fair share of the cpu. Users are NOT allowed to run bots on their server at any time.

Boosted: We will allow a boosted server to run at a max rate of 500 or 1000 Frames Per Second (FPS). We do not guarantee that a boosted server will run at a constant rate of 500 or 1000 FPS.

Back-ups: The Client is solely responsible for backup and protection of data files stored on Gizzmos Networks' servers. We will not be held responsible if you lose any data on our servers.

Paying Admins: Kicking is only allowed if you have good reason to do so. If another admin is present, please consult him/her before taking action; if no other admins are present, use your own judgment wisely. Kicking because you don't like someone is not allowed.

If you are going to change the map on a server because 1-2 players have requested it then think about the other players on the server first. At Gizzmos Networks admins are not allowed to change maps without voting the map first. We think it's fairer as it will stop annoying the players that just want to play and not be hassled with constant map changes.

If you use any command too excessively every player in the server has the right to report you for abuse. If you are reported for abuse we will first give you a warning. The second time it happens we will remove your account for 72 hours. The third time it happens we will remove your account for the remainder of the month.

Failure to comply with these rules may lead to loss of admin controls or even expulsion from Gizzmos Networks servers.
